GreenPan ‘Mystery Sale’ and ‘Mystery Sale Lucky Draw’ terms and conditions
The following terms and conditions apply to the “Mystery Sale” and “Mystery Sale Lucky Draw” campaign (hereinafter
the "Promotion") organized by The Cookware Company Australia Pty Ltd., located at Level 21, 55
Collins Street, Melbourne Victoria 3000, Australia with company number 639 575 054 (hereinafter
“Promotor”)
Conditions of the Promotion
The Promotion starts at 00:01AM (NZD) on September 1, 2024 and 23:59AM (NZD) September 10, 2024 (hereinafter the
“Promotional Period”).
Only a purchase with final payment will grant you a mystery box during the Promotional Period. This does not include
lay-bys unless the final lay-by payment is made during the Promotional Period. Use of services such as Afterpay and
Zippay transactions does not constitute a purchase unless payment is made in full during the Promotional Period.
A purchase of mystery boxes made during the Promotional Period is final. No exchange or refund will be provided. Only
in case of a defective item, we will replace it with the same (or a comparable item, subject to availability) or
refund the purchase amount, depending on the circumstances. This disclaimer applies only to this Promotion.
The Promotion cannot be combined with other offers, discounts, or promotions.
Eligibility & Entries
- To be eligible to enter the Promotion, each participant must:
a. be an New Zealand resident currently living in New Zealand with a New Zealand residential address;
b. be aged 18 years old or over, or if under the age of 18, have obtained the consent of their parent or legal
guardian to participate in this Promotion; and
c. be the Participating Product’s end-user, meaning the participant must Purchase a mystery box for their own use
and not for commercial purposes, re-sale, resupply, rental, hire purchase or any other indirect use;
Participants must ensure that all personal details provided are correct.
‘Mystery Sale Lucky Draw’
Any purchase of a mystery box made during the Promotional Period will grant the participant one (1) entry to the
draw. This means that if a participant purchases 2 mystery boxes, his/her name will be added 2 times.
The winning prize is a GreenPan Omni Cooker (black colour) valued at $369
(hereinafter the “Prize”). The Prize does not include any additional products or services. The Prize
cannot be exchanged for cash. The winner is responsible for all costs and obligations associated with the Prize,
including, but not limited to, taxes
One (1) winner will be randomly selected by a computer-generated random selection programme. The person selected will
be contacted by the Promoter directly. This random selection and announcement will happen no later than September 16,
2024.
If the Promoter cannot contact the winner within 48 hours and all reasonable attempts – via phone & email have been
attempted, the Promoter will re-draw that person’s place in the Promotion.
General Conditions
The Promotor reserves the right to cancel, suspend, or modify the campaign at its sole discretion after verification
of the eligibility of the participant.
The Promotor is not responsible for any technical issues, delays, or other problems that may occur during the
campaign period. In case of technical or logistical problems during the collection campaign, the Promotor will try to
resolve the issue as soon as possible to the best of their ability. The Promotor is under no obligation to extend the
duration of the Campaign.
The Promotor reserves the right to withdraw this Promotion at any time without incurring any liability.
The Promotor cannot be held liable for any damages resulting from the misuse of its products. You are obliged to
follow the information provided on and/or within the product packaging.
Should The Promotor be liable for damages, our liability is, in any case, limited to direct damages only. The
exclusions and limitations of liability in these terms and conditions do not apply to our liability that cannot be
excluded or limited under (mandatory) applicable law.
If a provision is declared invalid, these terms and conditions will be interpreted as if such an invalid or
unenforceable provision had never been included.
By participating, you agree to be bound by these terms and conditions and the decisions of the Promotor, which are
final and binding in all respects.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Victoria.
Any disputes arising out of or in connection with this campaign shall be subject to the exclusive jurisdiction of the
courts of Victoria.
